President Obama may be experiencing Déjà vu shortly as history repeats itself

Who can forget President G. H. W. Bush when he said:



That clip was played over and over by the Bill Clinton campaign. Bush eventually lost a second term.

The question is, As a result of The SCOTUS ruling that Obama care is a TAX, after attorneys for the President argued this, Is this President Obama's "Be Careful What You Wish for" moment?

Did he win the battle only to lose the War?

Joe Battenfeld of the Boston Herald had this to say:
The chief justice knows that the president has been running around denying that Obamacare is a tax, and he knows the administration then called it a tax in its arguments before the high court.

So, in essence, Roberts may have been sending a message to the White House; you want a tax? You got it.
So Roberts may have done two things whether deliberate or not:

1. Voters (not the SCOTUS) will be deciding whether to overturn the law by electing Mitt Romney.
2. A new Battle Cry for Republicans in their efforts to take control of the Senate in order to insure that Obamacare is repealed.

President Obama to Soldiers & Veterans: I want you to pay higher health Care fees

On the day after the Supreme Court breathed new life into Obamacare, The Obama administration decides to try and SCREW our soldiers and veterans with higher health care fees. Some feel this is no more than a means of forcing them into state run insurance exchanges.
The Obama administration on Friday threatened to veto a defense appropriations bill in part because it does not include higher health care fees for members of the military.

“The Administration is disappointed that the Congress did not incorporate the requested TRICARE fee initiatives into either the appropriation or authorization legislation,” the White House wrote in an official policy statement expressing opposition to the bill, which the House approved in May.

According to FactCheck.org, 'No Evidence Romney Shipped Jobs Overseas'

This should put to rest the claims that the Obama Campaign are making against Mitt Romney...but it probably won't:
...after reviewing numerous corporate filings with the Securities and Exchange
Commission, contemporary news accounts, company histories and press releases, and the
evidence offered by both the Obama and Romney campaigns, we found no evidence to support the claim that Romney — while he was still running Bain Capital — shipped American jobs overseas.

Roberts just Gift Rapped the Oval Office for Mitt Romney

Contrary to conventional wisdom, an anti-tax backlash over the Supreme Court’s blockbuster decision upholding Obamacare could propel Mitt Romney all the way to the Oval Office, national Republicans said, as irate voters pumped millions into his campaign coffers in the wake of the surprise ruling.

I Don't get it! Until Obamacare is amended by Congress, isn't it still a mandate under the Commerce Clause?

The Supreme Court ruled that a mandate is unconstitutional under the Commerce clause in which the current bill was based and written.

Are you with me?...

Now the court said that as a "Tax" it would be constitutional.

The bill however "AS WRITTEN" implies mandate, not tax. President Obama on numerous occasions has said it's "NOT A TAX"

So What I am asking is, UNTIL the President admits its a tax and not a mandate, and the bill is re-written to imply this, Why can't states refuse to comply on the grounds that the Supreme Court deems that a mandate is unconstitutional under the Commerce Clause and therefore the CURRENT BILL AS WRITTEN is unconstitutional?

Now I'm not a lawyer...Does this make any sense?

Justices Kennedy, Scalia, Thomas, and Alito: ruling is a ‘rewrite’ of the law

Justice Anthony Kennedy and three conservative justices denounced the majority opinion declaring the individual mandate as a tax, authored by Chief Justice John Roberts, as an effective rewrite of the Obamacare legislation that accepted “feeble” arguments from President Obama’s attorneys.

“[T]o say that the Individual Mandate merely imposes a tax is not to interpret the statute but to rewrite it,” the dissenters — Justices Scalia, Thomas, Alito, and Kennedy — wrote, adding that “legislators must weigh the need for the tax against the terrible price they might pay at their next election.” He then suggested that Congress intentionally avoided passing the mandate as a tax in an effort to avoid that election disaster. “We have no doubt that Congress knew precisely what it was doing when it rejected an earlier version of this legislation that imposed a tax instead of a requirement-with-penalty.”

GOP Governors plan to ignore Obamacare until after the election

Republican governors are planning to ignore the Supreme Court's decision Thursday to uphold Obamacare hoping that the issue will drive voters to dump President Obama in favor of Mitt Romney who has vowed to kill the Affordable Care Act.

After the decision, the Republican Governors Association said that nothing should be done by the states until after the election, a clear signal that they believe a GOP president, House and Senate will kill the health care reform pushed through by Democrats and opposed by Republicans.

Why Chief Justice Justice John Roberts Made The Right Decision On ObamaCare

Given that I have been extremely busy lately with my law work, I haven't had time to keep up on my blog. However, I would like to share my thoughts on the Supreme Court's ruling on ObamaCare today. I'd like to my observations about Chief Justice John Roberts which will help me unpack my thoughts on ObamaCare. 

Many people on both the Left and the Right are surprised that Chief Justice Roberts joined the majority in upholding ObamaCare. While the Left is overjoyed with him, the Right are not only surprised by his position but there seems to be a bit of a mystery as to when he decided to uphold ObamaCare. For me, I'm not interested in solving that mystery and quite frankly I don't care when or why he switched. 

What I do care about is the impact of his decision on our country. I haven't read the entire decision yet (I'll probably get around to it this weekend) but unlike other conservatives, I am happy with the fact that he joined the majority in upholding ObamaCare. Let me explain why. 

Prior to the ruling conservatives were worried that if the Affordable Care Act (ACA) was held constitutional, then it would give Congress unlimited regulatory power. But by holding that ObamaCare as unconstitutional under the Commerce clause of the U.S. Constitution, he has halted the expansion of that power and has now set the stage to shrink the Commerce Clause back to its proper constitutional boundaries: 
Construing the Commerce Clause to permit Congress to regulate individuals precisely because they are doing nothing would open a new and potentially vast domain to congressional authority. Congress already possesses expansive power to regulate what people do. Upholding the Affordable Care Act under the Commerce Clause would give Congress the same license to regulate what people do not do. The Framers knew the difference between doing something and doing nothing. They gave Congress the power to regulate commerce, not to compel it. Ignoring that distinction would undermine the principle that the Federal Government is a government of limited and enumerated powers. The individual mandate thus cannot be sustained under Congress’s power to “regulate Commerce.”
Chief Justice Roberts may have made a smart and crafty move by giving Obama limited political victory while holding that ObamaCare is unconstitutional under he Commerce clause, the Necessary and Proper Clause or the Spending Clause.  

When I say that Chief Justice Roberts gave Obama a political victory, its a limited victory and its a win that may not last very long. In fact, I believe that Roberts intentionally and cleverly designed it to be a short term victory by holding it to be a constitutionally valid exercize of Congress' power to tax: 
Our precedent demonstrates that Congress had the power to impose the exaction in Section 5000A under the taxing power, and that Section 5000A need not be read to do more than impose a tax. This is sufficient to sustain it.The court reinforces that individuals can simply refuse to pay the tax and not comply with the mandate.
How short could this victory be? It could be less than a month

House Majority Leader Eric Cantor (R-Va.) has promised to hold a vote on July 11th to repeal ObamaCare after Congress gets back from its July 4th recess. House Speaker John Boehner is also behind the effort to repeal this law as quickly as possible.  But a full repeal is not likely to happen. The vote to repeal it will certainly pass in the House where the Republicans are a majority but not in the Senate where Democrats have a slim majority.

The victory could come as short as 130 days when America goes to the ballot box to decide to either keep the current President or get a new one. As Mitt Romney explains it, the only way to repeal ObamaCare is to get rid of Obama. Mitt Romney has repeatedly promised that he will repeal ObamaCare on his first day in office. 

However, voting for Mitt Romney to be our new President won't fully repeal ObamaCare. We need a Republican majority in both houses of Congress. We already have a Republican majority in the House and we need to keep that majority in 2012. We also need to make the Democrats a minority in Congress by getting as many Republicans in the Senate as possible.

But lets get back to small victory that Chief Justice John Roberts gave to Obama. By limiting the constitutionality of ObamaCare to Congress power to tax, he's has laid the groundwork for Congress to repeal it very easily. Congress can do whatever it wants with taxes. They can raise taxes, lower taxes or eliminate it all together.

Nancy Pelosi famously told the American people that we had to pass ObamaCare to find out what it is in it. Republicans charged that the federal individual mandate was a tax and Obama denied that accusation.  

Americans hate taxes. And they also hate ObamaCare just as much.  And that's a lethal combination, especially for an incumbent President running for reelection. 

Americans will not be happy to find out that the Democrats lied to them for denying it was a tax and the Supreme Court did what Nancy Pelosi asked the American people to do by looking what is in the law and Congress passed the law only to find out that it was...another tax increase on the American people. That means that 26 million people or roughly around 70-75 percent of the people who make less than $200,000 a year, will now be paying a new additional tax which is estimated to be a $1.7 trillion tax over the first decade.

If you think about it, declaring ObamaCare as constitutionally valid tax increase is such an intelligent yet simple and elegant way of repealing ObamaCare since he properly placed the responsibility of repealing it back to Congress (where it should belong) and the American people.  

Thus, Obama's victory is a limited and hollow one since Roberts is essentially saying that Obama is a tax loving Democrat which leaves nothing really good for the President to cheer about during the election season:
Republicans would have preferred the court overturn the health care bill, an act that would have underscored Obama's biggest liability -- the perception among voters, including those who like and trust him, that he has been ineffective.

But you can count on them to use Roberts' bill-saving justification to label Obama a tax-and-spend liberal.

"I'm sure they'll nail us on taxes and I'm sure it will work," said a senior White House official speaking on condition of anonymity. "But, given the alternative, that's a bitter pill I'm ready to swallow."
By upholding ObamaCare, Obama's victory is a short lived victory for the President since it leaves him in an politically uncomfortable position for the rest of the election year and may end up costing him his job:
Obama is boxed in. What is he to do? He can't criticize the Court for judicial activism, as it upheld the law (putting aside the way the Court limited the Medicaid provisions, which are not particularly salient to voters). The decision undercuts a potential theme of his campaign -- that a conservative Court is out of control. And yet Obama can't trumpet the decision either, since it states that Democrats overreached in trying to justify the law under the Commerce Clause. 
Worse yet, it calls the mandate something that Democrats didn't want it to be: a tax. 
Conversely, the decision may be the optimal result for Mitt Romney. If the Court had struck down the mandate, it would have taken off the table an issue that Republican base voters care tremendously about. But in upholding the law, the Court didn't just leave that issue on the table; it gave Romney tremendous ammunition he can use to criticize Obama as a tax raiser. 
There was much contrarian wisdom floating around prior to the decision about how a defeat might be helpful to Obama, as he could run against the Court. Jeffrey Toobin criticized this as "nonsense": "Winners win, and losers lose." We'll never know if Obama could have potentially won by losing the health care case. But the coming months will tell whether he might have lost by winning.
In the end, Chief Justice John Roberts did the right thing by joining the liberal 5-4 majority by working within the system to engineer the eventual demise of ObamaCare.

SCOTUS Decision Has Lasting Ramifications

The SCOTUS decision on the PPACA (ObamaCare) has lasting ramifications. Their decision was not about the PPACA or the Individual Mandate. Their decision is levelled at the rights Congress has to raise and lower taxes. Essentially, PPACA stands because, as the SCOTUS rules, it is a tax*.

What does this ruling mean? Guess who owns GM... the government does. Is GM not doing so well? Then let's force everyone to buy a GM car. But that's not constitutional! It doesn't matter, attach a tax to it (with a penalty for not purchasing, of course) and now you are forced to own a GM car.

Congress decides that everyone must purchase an Apple computer. But that's not constitutional! It doesn't matter, attach a tax to it (with a penalty for not purchasing, of course) and now you are force to own an Apple computer.

You get the point. The SCOTUS has now ruled that Congress can tax behavior.

Polls show Obama's immigration decision on young illegal immigrants turns off voters in Ohio, Pennsylvania and Florida

The Quinnipiac polls in Florida, Ohio and Pennsylvania show that, while most voters still like the policy and Obama continues to lead Mitt Romney in all three states, the opposition to the move appears to be significantly more motivated by it — particularly in the two Midwestern states.

In both Ohio and Pennsylvania, more than twice as many respondents say the decision makes them less likely to support the president (27 percent in both) as say it makes them more likely to back him (12 percent in Pennsylvania, 11 percent in Ohio).

In Florida, the split is less pronounced, with 22 percent saying the move makes them less likely to support Obama and 17 percent saying it makes them more likely to support him. Still, though, the opposition wins the day, even in a heavily Latino state (though we should note that Florida’s Latinos — many of them Cuban-Americans — tend to be more conservative than in other states).

Please Help me understand: Are the majority of Ameican women NUTS?

Poll.... after..... poll.... after.... poll.... after.... poll.... poll... I could go on and on.

I can't take it anymore.

What the Hell do all these women see in Barack Obama?

If it's policies that benefit you?...your kids...your spouse...Clue me in.

If it's because he's a "nice guy"...That's a PRETTY STUPID reason to vote for someone. He was a nice guy..4 years ago...look where it got us.

I heard he's a good dancer...Is that it?

If it's because he's cute, so's my dog. I wouldn't vote for him either.

Obama thumbs his nose at the Immigration Decision and Arizona

Obama is planning to tell Arizona, Don't call us, we'll call you.

In an effort to tie the hands of Arizona's police, The Obama administration is suspending any agreements they've had with Arizona Police in the past:
The Obama administration said Monday it is suspending existing agreements with Arizona police over enforcement of federal immigration laws, and said it has issued a directive telling federal authorities to decline many of the calls reporting illegal immigrants that the Homeland Security Department may get from Arizona police.
Administration officials, speaking on condition they not be named, told reporters they expect to see an increase in the number of calls they get from Arizona police — but that won’t change President Obama’s decision to limit whom the government actually tries to detain and deport.

“We will not be issuing detainers on individuals unless they clearly meet our defined priorities,” one official said in a telephone briefing.

Under the SCOUS rulling, Arizona has the right to check the legal status of those they have reasonable suspicion to believe are in the country illegally. But it stops there. This new policy by the Obama administration basically thwarts any efforts by the Arizona police to report illegal immigrants found during there investigations and makes the ruling by the Scotus unenforceable.

I've come to believe that some countries deserve to be ruled... Change? Democracy?

They just can't handle it!

Two perfect examples are Iran and Egypt:

When Mohammad Reza Shah Pahlavi (Shah of Iran) ruled Iran, There was never a thought of instability in that region.

He kept the Muslim (Nut Case) clerics in their place (Mosques) and ran the country with a tight fist and western influence.

In the context of regional turmoil and the Cold War, the Shah established himself as an indispensable ally of the West. Domestically, he advocated reform policies, culminating in the 1963 program known as the White Revolution, which included land reform, the extension of voting rights to women, and the elimination of illiteracy....

....The shah's regime suppressed and marginalized its opponents with the help of Iran's security and intelligence organization, the SAVAK. Relying on oil revenues, which sharply increased in late 1973, the Shah pursued his goal of developing Iran as a mighty regional power dedicated to social reform and economic development.
During this period, The Shah had close ties with Israel.

Then came the uprisings of 78-79....The U.S, being critical of the Shah ( you guessed it....President Carter)...Ayatollah Khomeini returning from exile....taking of American hostages...Democracy at work?

Then there is Egypt and Mubarak who came to power after the assination of Anwar Sadat. Both of these men ruled with a tight fist keeping the Muslim (Nut Case) clerics in the Mosques WHERE THEY BELONG!

Stability in that region...cordial relationships with Israel and the U.S.

Then...Kdafi's downfall in Morroco....discontent in Egypt...U.S. being critical of Mubarak (Cartet 2..I mean President Obama)....riots...Mubarak forced out....Let Freedom ring....Do you think?

Democracy sure worked great in these instances?
