Someone needs a refresher course in the U.S. Constitution.
The Democratic Socialist — really, the Communist and Islamic supremacist — Zohran Mamdani, has reissued his threat that, if he is elected mayor of New York, and Benjamin Netanyahu should appear in the city, he would not hesitate to arrest him. Is New York City mayoral candidate Zohran Mamdani preparing to violate international law, as well as US Federal law?It’s well known that the candidate has promised to arrest Israeli Prime Minister Benjamin Netanyahu, which he justifies by saying that this will make New York “consistent with international law.”The shocking truth is that doing so will actually violate the very laws and moral principles Mamdani claims to uphold.In November of last year, in an absurd and politically motivated decision, the International Criminal Court (ICC) issued international arrest warrants against Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant.Some countries, such as the Netherlands, Ireland, Lithuania, Slovenia, Spain, and Canada, enthusiastically announced their intention to arrest the Israeli leaders if given the opportunity.Others, such as Italy, Germany, Hungary, Poland, France, and Argentina have rejected the arrest warrants, while some, such as the United States, both rejected the warrants and also strongly condemned the ICC decision.Then-US President Joe Biden condemned the warrants as “outrageous,” while current President Donald Trump went even farther, slapping sanctions on the ICC.This consistent bipartisan reaction should not be surprising: despite its misleading name, the International Criminal “Court” is not actually a court at all, but a political body, formed in 2002 by a treaty called the Rome Statute. Even as far back as the drafting of this treaty in the late 1990s, numerous countries, including the United States and Israel, concluded (correctly) that the Rome Statute would be eventually abused for political agendas, and therefore refused to sign.Yet America went even farther: understanding that the ICC could be a dangerous political weapon, Congress passed a bipartisan law in 2002 called the American Servicemembers’ Protection Act (ASPA). The Act not only prohibits the United States and all American government bodies from cooperating with the ICC, but also calls on Washington to defend US service members and US allies against the ICC. Therefore, any attempt by the City of New York to enforce an ICC arrest warrant would be a direct violation of Federal law, and potentially subject to Federal prosecution.Mamdani’s misguided promise to enforce a foreign treaty that does not even include the United States, would violate not only US Federal law, but international law as well….

The mayoral nominee’s threat against the Israeli prime minister is both ludicrous and sinister.
t’s easy to mock Zohran Mamdani’s pledge that he will order the New York City Police Department to arrest Benjamin Netanyahu if the Israeli prime minister visits the city while Mr. Mamdani is mayor. Does he expect the NYPD to overcome Mr. Netanyahu’s Shin Bet and Secret Service bodyguards? Or will a New York City Criminal Court judge issue a warrant and wait for the prime minister to turn himself in? Has Mr. Mamdani even heard of diplomatic immunity?
The Democratic mayoral nominee claims he would be carrying out the will of the International Criminal Court, but that position defies both U.S. foreign policy and law. Neither the U.S. nor Israel ever joined the court, and presidents from both parties have dismissed it as unaccountable, politicized and a threat to sovereignty. In 2002, Congress enacted the American Servicemembers’ Protection Act, which flatly prohibits state and local officials from helping the ICC target U.S. personnel or leaders of allied nations. The only Americans who are legally authorized to cooperate with the ICC are federal officials acting against America’s enemies.
Mr. Mamdani’s position is a mockery even of the ICC’s rules. Under the Rome Statute’s complementarity principle, the court can intervene only when a country is “unwilling or unable” to hold its leaders accountable. Israel, with its active and independent judiciary, hardly qualifies.
The ICC’s charges against Mr. Netanyahu are a travesty. Its arrest warrant accuses him of intentionally starving civilians in Gaza—never mind that Israel has facilitated the delivery of more than a million tons of food to the strip.
